The purchase or sale of commercial properties can be more complex as there are often additional issues to be considered when compared to residential property transactions. These include:

  • GST implications;

  • whether the property is subject to a lease and the terms and conditions of the lease
  • whether there are existing "services agreements" attached to the property such as cleaning agreements or lift servicing agreements
  • local council requirements in relation to the use of the building and any proposed development of the building; and
  • contamination of land, in particular, those properties which have an industrial use
